2. Service Description

CrowPhone provides temporary phone number rental services that allow users to:

• Rent phone numbers from various countries
• Receive SMS messages and phone calls
• Make outbound calls (when available)
• Protect privacy and maintain anonymity

3. Eligibility

To use our Service, you must:

• Be at least 18 years old
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service by any applicable laws
• Provide accurate and complete information

4. Account Registration

When creating an account:

• You must provide a valid email address
• You are responsible for maintaining account security
• You must not share your account credentials
• You must notify us immediately of any unauthorized access
• You are responsible for all activities under your account

5. Prohibited Uses

You agree NOT to use the Service for:

• Illegal activities or to violate any local, state, national, or international law
• Harassment, abuse, or threatening others
• Sending spam or unsolicited messages
• Fraud, phishing, or other deceptive practices
• Impersonating any person or entity
• Interfering with or disrupting the Service
• Attempting to gain unauthorized access to our systems
• Reselling or redistributing the Service without authorization
• Automated use or scraping without written permission

6. Payment Terms

6.1 Pricing

Prices are displayed in USD and may vary by country and service type. We reserve the right to change pricing at any time.

6.2 Payment Processing

Payments are processed through Lemon Squeezy. By making a payment, you agree to their terms of service.

6.3 Refunds

Account balance top-ups are non-refundable. Unused credits remain in your account for future use. Refunds may be issued at our sole discretion in case of service failures.

6.4 Taxes

You are responsible for any applicable taxes. Prices do not include sales tax, VAT, or other taxes unless explicitly stated.

7. Service Availability

We strive to provide reliable service, but:

• Service may be interrupted for maintenance or updates
• Phone number availability varies by region
• We do not guarantee 100% uptime
• Third-party services (Twilio) may experience outages
• Message delivery is not guaranteed

8. Content and Data

8.1 Your Content

You retain ownership of messages and data you send through the Service. By using the Service, you grant us a license to store and transmit your content as necessary to provide the Service.

8.2 Data Retention

SMS messages and call logs are retained for 90 days after the rental period. After this period, data is automatically deleted.

9. Termination

9.1 By You

You may terminate your account at any time by contacting us. Unused balance will not be refunded.

9.2 By Us

We may suspend or terminate your account immediately if you:

• Violate these Terms and Conditions
• Engage in fraudulent activity
• Use the Service for illegal purposes
• Cause harm to other users or the Service

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation
• Security or absence of viruses

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROWPHONE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Service interruptions or data loss
• Unauthorized access to your account
• Actions of third parties

Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.

12. Indemnification

You agree to indemnify and hold harmless CrowPhone and its affiliates from any claims, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CrowPhone operates, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
